SANGGUNIANG BAYAN OF DAET INVITES THE PEOPLE OF DAET TO A PUBLIC HEARING ON FEBRUARY 15, 2017; 2:00 P.M.; AT SB SESSION HALL – PROPOSED ORDINANCE ENTITLED: “AN ORDINANCE PROHIBITING THE SMUGGLING/SNEAKING-IN OF CONTRABAND IN DAET DISTRICT JAIL AND IMPOSING PENALTIES FOR VIOLATION THEREFOR”
Salient Provisions:
SECTION 2. DEFINITIONS. For purposes of the penal clause of this ordinance, contraband shall refer to any of the following:
a. Dangerous drugs as enumerated in Republic Act No. 9165, drug paraphernalia, and alcohol and tobacco products;
b. Weapons (i.e. blunt, sharp, icepick and the like which can be used as weapon to harm oneself and others), flammable liquids and other hardware that may aid in escape such as ropes and cutting tools, unless previously authorized in writing by the Jail Warden for use in livelihood activities;
c. Cellphones and other communication gadgets that may aid in escape; d. Other items that may be classified as instruments of self-destruction and to others.
SECTION 3. PROHIBITION. Without prejudice to prosecution under other pertinent statutes, it is hereby prohibited for any visitor who shall come and visit an inmate in Daet District Jail to smuggle and/or sneak-in any form of contraband as defined in Section 2 hereof inside the jail facility.
Violation of this ordinance shall be deemed consummated if the visitor shall be found in possession of the prohibited items during an authorized search.
